Notice of Ordinance Introduction
AN ORDINANCE AMENDING CHAPTER 217 OF THE CODE OF THE
BOROUGH OF CALDWELL, ENTITLED “TAXATION”
WHEREAS, upon the recommendation of the Tax Collector and Tax Assessor, the Borough is desirous of amending an ordinance regarding taxation in the Borough of Caldwell.
NOW THEREFORE BE IT RESOLVED, that Chapter 217, shall be amended to add the following section:
Article II DISABLED VETERAN TAX EXEMPTION.
§ 217-3 ALLOWANCE OF TAX EXEMPTION. The Borough will allow for either a veteran or surviving spouse of a veteran to obtain municipal property tax relief upon proper claim pursuant to N.J.S.A. 54:4-3.30 et seq. An “eligible veteran” shall be defined as a member of the armed forces who was either honorably discharged or released under honorable circumstances from active service, in any branch of the Armed Forces of the United States, who has been or shall be declared by the United States Veterans' Administration or its successor to have a service connected disability and to be determined to be 100% permanently disabled as defined in N.J.S.A. 54:4-3.30, et seq., as amended from time to time, and that the veteran meets all other qualifications required by N.J.S.A. 54:4-3.30, et seq., as amended from time to time.
§ 217-4 QUALIFICATION. In order to qualify for the Borough’s tax exemption, the veteran or someone on their behalf, or the spouse of a veteran, under oath, must file a written claim with the Tax Assessor's office. The Tax Assessor's office will supply the applicant with the appropriate application, and the applicant will be required to provide the Tax Assessor's office with the following information:
1. A completed, signed application;
2. Reason for exemption;
3. A description of the property for which the exemption is claimed;
4. A certificate of claimant's honorable discharge or release under honorable circumstances from active service, in time of war, and a certificate/letter from the United States Veterans' Administration or its successors, certifying to a service-connected disability and that the disability is 100% permanent as provided in N.J.S.A.54:4-3.30, as amended from time to time; and
5. Any other documentation as required by statute or the Tax Assessor at the time the application is made.
§ 217-5. REFUNDS.
In determining a grant of a Borough tax exemption under this section, the Borough will prorate the exemption for the remainder of the year in which application is made, deemed complete and accepted by the Borough, from the date of filing of the completed application with the Tax Assessor. There shall be no retroactive refund granted, regardless of the date the veteran was declared disabled by the United States Veterans' Administration.
BE IT FURTHER RESOLVED, that if any section of this Ordinance shall be deemed invalid or unconstitutional, such section shall not affect the remainder sections and each provision shall be independent of the others; and
BE IT FURTHER RESOLVED, that this Ordinance shall become effective upon approval and publication as required by law; and

Please take Notice that the foregoing ordinance was introduced at a meeting of the Council of the Borough of Caldwell on the 21st day of July, 2026 and passed on first reading; and the same was then ordered to be published according to law; and that such ordinance will be further considered for final passage at a meeting of the Council to be held on the 11th day of August, 2026 at seven p.m. at the Saint Aloysius Parish Gymnasium located at 219 Bloomfield Avenue, Caldwell, NJ 07006, or at a prevailing time or as soon thereafter as the matter may be reached, at which time and place, or at any time and place to which such meeting shall from time to time be adjourned, all persons interested will be given an opportunity to be heard concerning such ordinance.
